At BiBoom, your privacy is a top priority. Your privacy is at the core of the way we design and build the services and products you know and love, so that you can fully trust them and focus on building meaningful connections.

We appreciate that you put your trust in us when you provide us with your information and we do not take this lightly.

We do not compromise your privacy. We design all of our products and services with your privacy in mind. We have experts from various fields, including legal, security, engineering, product design and others to make sure that no decision is taken without respect for your privacy.

We strive to be transparent in the way we process your data. Because we use many of the same online services as you do, we know that insufficient information and overly complicated language are common issues in privacy policies. We take the exact opposite approach: we have written our Privacy Policy and related documents in plain language. We actually want you to read our policies and understand our privacy practices!

1. Where This Privacy Policy Applies

This Privacy Policy applies to websites, apps, events and other services operated by BiBoom. For simplicity, we refer to all of these as our “services” in this Privacy Policy. To make it extra clear, we’ve added links to this Privacy Policy on all applicable services.

Some services may require their own unique privacy policy. If a particular service has its own privacy policy, then that policy -- not this Privacy Policy -- applies.

2. The Data We Collect From You

In order for you to utilize our Services, including but not limited to, creating a user account and being matched with other users, we collect the following data from you:

2.1 Data You Provide

This may include contact information (such as your full legal name, physical address, email address, gender, birthday, phone number), a photograph, occupation, current city, and payment and/or billing information (including your credit card number and billing address). To add certain content such as pictures to your account, you may grant us to access your device, including its camera or photo album. You may also provide what is classified as “special categories” of personal data under applicable law, such as your race, ethnicity, religion, philosophical or political views, and information relating to your sex life or sexual orientation. By choosing to provide this data, you consent to our processing of that data, which consent may be revoked by you at any time.

Correspondence with BiBoom: BiBoom may collect personal data from you if you contact us for customer service purposes and to resolve any issues or answering any questions you may have. In addition, if you participate in any surveys or research groups, we will also be collecting your insights into our products and services, as well as responses to any questions or prompts included in such surveys or research groups. If you choose to enter into any contests we offer, we will also be collecting any data from you that is required to register for entry.

Referrals: We encourage you to refer your friends to use our Services by sending us your friends’ email addresses or phone numbers. We will keep this data in our database, and enable you to send these friends a one-time email or text message from your device containing your name and inviting them to use our Services. This email will also include instructions on how to opt out and unsubscribe from our email list. You agree that you will not abuse this feature by entering the email addresses or phone numbers of those individuals who would not be interested in using our Services.

Matching with Users: When you use our Services, and are matched with another user, you may be communicating with that other user. In such an instance, we may be receiving content on your behalf, anonymizing such data, then distributed it to another user.

2.2 Data We Automatically Collect When You Use the Services

Log Data: Whenever you user our Services, we collect data automatically that your browser sends to us that is called Log Data. This Log Data may include data such as your computer’s Internet Protocol (“IP”) address, browser version, pages of our website that you visit, the time and date of your visit, the time spent on those pages, and other statistics.

Device Data: We collect and store data about the computer or mobile device you use to access our Services, including your mobile device's unique ID number (e.g., IMEI, AD ID), your geographic location, the hardware model, operating system and version.

Email Data: Email messages we send to you may contain code that enables our database to track your usage of the e-mails, including whether the e-mail was opened and what links (if any) were clicked.

Usage Data: We may collect data about your participation and actions within our Services, such as the accounts you view, how you browse the Services and related insights. It can also include the various functions and features that you use, the connections you make, others you invite or refer to the Services and searches you perform.

3.How We Use Information

The main reason we use your information is to deliver and improve our services. Additionally, we use your info to help keep you safe and to provide you with advertising that may be of interest to you. Read on for a more detailed explanation of the various reasons we use your information, together with practical examples.

3.1 To help you connect with other users

Analyze your profile, activity on the service, and preferences to recommend meaningful connections to you and recommend you to others.

Link the various devices you use so that you can enjoy a consistent experience of our services on all of them. We do this by linking devices and browser data, such as when you log into your account on different devices or by using partial or full IP address, browser version and similar data about your devices to help identify and link them.

4. Who We Share Your Data With

4.1 Users You Match With

We share your data with other users of the Services with whom you match with, and as such, our Services allow for the viewing and sharing of your personal data. For example, your Facebook friends’ names and one profile picture can be shared with your matches who are already friends with these Facebook friends.

4.2 With Investigators, Governmental Bodies, Authorities or Law Enforcement Agencies

We may share your data if we believe it is required by applicable law, regulation, operating agreement, legal process or governmental request, or where the disclosure is otherwise appropriate due to a safety or similar concern. This includes sharing your data with law enforcement officials, government authorities, or other third parties as necessary to enforce our Terms of Use, user agreements or other policies, as well as to investigate and protect Down or its users from fraudulent, abusive, inappropriate, or unlawful use of our Services.

4.3 With Potential Buyers or Investors

We may share your data with others in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restricting, financing, or acquisition of all or a portion of our business by or into any another company, or as part of bankruptcy, liquidation, or similar proceeding, in which personal data held by BiBoom about its users is among the assets transferred.

5. Your Rights

We want you to be in control of your information, so we have provided you with the following tools:

Device permissions. Mobile platforms have permission systems for specific types of device data and notifications, such as phone book and location services as well as push notifications. You can change your settings on your device to either consent or oppose the collection of the corresponding information or the display of the corresponding notifications. Of course, if you do that, certain services may lose full functionality.

Deletion. You can delete your account by using the corresponding functionality directly on the service.

We want you to be aware of your privacy rights. Here are a few key points to remember:

Reviewing your information. Applicable privacy laws may give you the right to review the personal information we keep about you (depending on the jurisdiction, this may be called right of access, right of portability or variations of those terms). You can request a copy of your personal information by contacting us at [email protected].

Updating your information. If you believe that the information we hold about you is inaccurate or that we are no longer entitled to use it and want to request its rectification, deletion or object to its processing, please contact us at [email protected].

For your protection and the protection of all of our users, we may ask you to provide proof of identity before we can answer the above requests.

Keep in mind, we may reject requests for certain reasons, including if the request is unlawful or if it may infringe on trade secrets or intellectual property or the privacy of another user. If you wish to receive information relating to another user, such as a copy of any messages you received from him or her through our service, the other user will have to contact our Privacy Officer to provide their written consent before the information is released.

Also, we may not be able to accommodate certain requests to object to the processing of personal information, notably where such requests would not allow us to provide our service to you anymore. For instance, we cannot provide our service if we do not have your date of birth.

Uninstallation. You can stop all information collection by an app by uninstalling it using the standard uninstallation process for your device. If you uninstall the app from your mobile device, the unique identifier associated with your device will continue to be stored. If you re-install the application on the same mobile device, we will be able to re-associate this identifier to your previous transactions and activities.

Accountability. In certain countries, including in the European Union, you have a right to lodge a complaint with the appropriate data protection authority if you have concerns about how we process your personal information. The data protection authority you can lodge a complaint with notably may be that of your habitual residence, where you work or where we are established.

6. How Long We Retain Your Data

BiBoom only retains user profile and other data as long as you have a user account and utilize the services. You may request deletion of your account at any time by emailing BiBoom at [email protected] and making such request. Upon receipt of a request to delete your account and data, BiBoom will delete your account within forty-eight (48) hours after request.

However, since we are subject to compliance with different laws in place around the world relating to regulatory, tax, insurance or other requirements in the field in which it operates, BiBoom will maintain data related to the foregoing, which may include transaction history, for one (1) year. Thereafter, BiBoom will delete such data in accordance with applicable laws.

7. How We Protect Your Information

We work hard to protect you from unauthorized access to or alteration, disclosure or destruction of your personal information. As with all technology companies, although we take steps to secure your information, we do not promise, and you should not expect, that your personal information will always remain secure.

We regularly monitor our systems for possible vulnerabilities and attacks and regularly review our information collection, storage and processing practices to update our physical, technical and organizational security measures.

We may suspend your use of all or part of the services without notice if we suspect or detect any breach of security. If you believe that your account or information is no longer secure, please notify us immediately at [email protected].

8. International Data Transfers

The personal data we collect may be transferred to, and processed and stored in, countries outside of the jurisdiction you are located in. For example, if you are located in a country with the EEA, your personal data may be processed in the United States. All international transfers of your personal data are made:

To a country or territory ensuring an adequate level of protection for the rights and freedoms of data subjects in relation to the processing of personal data as determined by the European Commission;

To a third party that is a member of a compliance scheme recognized as offering adequate protection for the rights and freedoms of data subjects as determined by the European Commission; or

Pursuant to appropriate safeguards, such as the Standard Contractual Clauses (processors) approved by European Commission Decision C(2010)593 or any subsequent version thereof released by the European Commission or the EU-U.S. Privacy Shield.

9. Cookies and Other Similar Data Collection Technologies

Like most providers of online services, we use cookies to provide, secure and improve our services, including by remembering your preferences, recognizing you when you visit our website and personalizing and tailoring ads to your interests. To accomplish these purposes, we may also link information from cookies with other personal information we hold about you.

There are several cookie management options available to you. Please note that changes you make to your cookie preferences may make browsing our website a less satisfying experience. In some cases, you may even find yourself unable to use all or part of our site.

Some web browsers (including Safari, Internet Explorer, Firefox and Chrome) have a “Do Not Track” (“DNT”) feature that tells a website that a user does not want to have his or her online activity tracked. If a website that responds to a DNT signal receives a DNT signal, the browser can block that website from collecting certain information about the browser’s user. Not all browsers offer a DNT option and DNT signals are not yet uniform. For this reason, many businesses, do not currently respond to DNT signals.

10. Age Restrictions

Our Services are not intended for individuals under 18 years of age. No one under age 18 may provide any data to or on the Services. We do not knowingly collect personal data from individuals under 18. If you are under 18, do not use or provide any data on our website or on or through any of Services or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal data from a person under age 18 without verification of parental consent, we will delete that information.
